Terms of Use

These Terms of Use (the “Terms”) govern your use of the Ember mobile application (the “App”) and the website at saunadiscovery.com (together, the “Service”), operated by the Ember team (“Ember”, “we”, “us”). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

Apple Standard EULA

The App is licensed, not sold, to you. Your licence to use the App is subject to Apple's Licensed Application End User License Agreement (the “Standard EULA”), which is incorporated into these Terms by reference. You can read it here: Apple Standard EULA. Where these Terms add to the Standard EULA, both apply; where they conflict on a matter the Standard EULA governs, the Standard EULA controls for the App obtained through the App Store.

The Service

Ember is a curated sauna discovery service. We hand-pick saunas, bathhouses, cold plunge spots, and thermal experiences, and provide guides, maps, and tools to help you discover and collect them. We may add, change, or remove places, features, and content at any time. Some information — such as opening hours, prices, and booking links — is provided for convenience and may not always be current. Always confirm details with the venue before you travel.

Subscriptions and purchases

The Service is free to use within your home region. You can unlock additional access through optional purchases made via the Apple App Store:

• Ember Pro— an auto-renewing subscription, offered on a monthly or yearly basis, that unlocks every region in the curated atlas, including regions and cities added in the future while your subscription is active.
• Region unlocks— one-time purchases that unlock an individual region permanently.

Prices are shown in the App in your local currency before you confirm. Purchases are processed by Apple and charged to your Apple Account.

Auto-renewal. An Ember Pro subscription automatically renews for the same period at the then-current price unless it is cancelled at least 24 hours before the end of the current period. Your Apple Account is charged for renewal within 24 hours before the period ends. You can manage or cancel your subscription in your Apple Account settings; cancellation takes effect at the end of the current billing period. Deleting the App does not cancel a subscription.

Refunds.Purchases and subscriptions are handled by Apple and are subject to Apple's refund policies. We are not able to process refunds directly; please request refunds through Apple.

Acceptable use

You agree to use the Service only for lawful, personal, non-commercial purposes. You may not copy, scrape, resell, or redistribute our curated content; reverse engineer or interfere with the Service; or use it in any way that infringes the rights of others or breaks applicable law.

Intellectual property

The Service, including its curation, editorial content, design, and trademarks, is owned by Ember or its licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms and the Standard EULA.

Disclaimers and limitation of liability

The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not own or operate the venues listed and are not responsible for your experience at them. Saunas, heat, and cold exposure carry inherent health risks — use your own judgement, follow venue guidance, and consult a medical professional if you have any health concerns. To the fullest extent permitted by law, Ember will not be liable for any indirect, incidental, or consequential loss arising from your use of the Service.

Our handling of your data is described in our Privacy Policy.

Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of Scotland and the United Kingdom, without regard to conflict-of-law principles, except where the Standard EULA or your local consumer protection law provides otherwise.
